These Terms are governed by the laws of Canada and the Province of Quebec, including the Civil Code of Québec and the Consumer Protection Act (LPC), without regard to conflict of law provisions. 2. Use of the Website The Website is intended for individuals and businesses located in Canada. By using the Website, you represent that you have reached the age of majority in your province or territory of residence and have the legal capacity to enter into binding contracts. You agree to use the Website only for lawful purposes and in compliance with all applicable municipal, provincial, federal, and international laws. Unauthorized use may result in suspension or termination of access. 3. Products and Services The Website offers equipment, machinery, consumables, software-enabled products, and related services, subject to availability. Payment and Billing All payments are processed in Canadian Dollars (CAD) unless otherwise stated. You agree to provide accurate and complete billing and payment information. We reserve the right to refuse or cancel any order in cases of suspected fraud, unauthorized activity, or pricing errors, in accordance with applicable law. 4.1 Interac e-Transfer (Manual Payment Method) Interac e-Transfer may be offered as a manual payment option. By selecting Interac e-Transfer, you acknowledge and agree that: Interac e-Transfer is not automatically confirmed Orders are processed and shipped only after payment has been received and manually verified The order number must be included in the transfer message Customers are responsible for entering correct security answers when required Interac e-Transfer payments are generally non-reversible once sent 3RVie is not responsible for delays, errors, or failed transfers caused by financial institutions or incorrect customer information Interac e-Transfer payments must be sent to the official email address designated by 3RVie: info@3rvie.ca 5. Equipment, Software, Platform & Consumables Use Certain equipment sold by 3RVie operates in conjunction with proprietary software, authorized consumables, QR-based activation systems, and/or a centralized online platform. The Customer acknowledges and agrees that: Certain functionalities, including cutting operations, may require QR-activated consumables or an active platform connection or subscription Only consumables provided or authorized by 3RVie may be used Some equipment may be sold with optional features such as “Unlimited Cuts”, which require payment of an annual platform or maintenance fee Failure to maintain required subscriptions, platform access, or authorized consumables may result in limited functionality or suspension of software-based services Such suspension does not constitute a defect, malfunction, or non-conformity of the physical equipment within the meaning of the Civil Code of Québec Ownership of the physical equipment does not grant ownership rights over the software, platform, activation systems, or related intellectual property, which remain the exclusive property of 3RVie or its licensors. 6. Shipping and Returns Shipping rates, methods, and estimated delivery times are provided separately on the Website. Customers are responsible for providing accurate shipping information. Orders paid via Interac e-Transfer are shipped only after payment confirmation. Returns, exchanges, and refunds are governed by our Return & Refund Policy, which complies with the Consumer Protection Act (Québec) and forms an integral part of these Terms. 7. Intellectual Property All content on the Website, including text, images, logos, software, platforms, activation systems, and documentation, is the property of 3RVie or its licensors and is protected by Canadian and international intellectual property laws. No content may be copied, reproduced, or distributed without prior written authorization. 8. Limitation of Liability To the fullest extent permitted by applicable law, 3RVie shall not be liable for damages arising from: Use or inability to use the Website Use of software-enabled equipment subject to platform, subscription, or consumable requirements Suspension or limitation of software-based services due to non-payment or misuse Nothing in these Terms limits rights that cannot be excluded under Québec consumer protection laws. 9. Indemnification You agree to indemnify and hold harmless 3RVie from any claims, losses, damages, or expenses resulting from misuse of the Website, products, software, consumables, or breach of these Terms. 10. Payment Policy
1. Accepted Payment Methods All payments made on 3rvie.ca are processed in Canadian Dollars (CAD). The following payment methods may be offered, subject to availability: Credit and debit cards Interac e-Transfer (manual payment method) We reserve the right to modify available payment methods at any time. 2. Interac e-Transfer (Manual Payment Method) By selecting Interac e-Transfer as a payment method, you acknowledge and agree that: Interac e-Transfer is a manual payment method and payments are not automatically confirmed. Orders are not processed, reserved, or shipped until payment has been received and manually verified by 3RV Import-Export Canada Inc. Customers must include their order number in the Interac e-Transfer message or notes field. If a security question or confirmation is required, customers must use the information provided during checkout. Interac e-Transfer payments are generally non-reversible once sent. The Company is not responsible for delays, errors, failed transfers, or incorrect payments caused by financial institutions or incorrect information provided by the customer. Interac e-Transfer payments must be sent to the official payment email designated by 3RVie: info@3rvie.ca . 3. Payment Verification Payments are verified during regular business hours. Until verification is completed, orders will remain in a pending payment status and will not be processed or shipped. 4. Order Processing & Reservation Order processing and shipment begin only after payment confirmation. Selecting Interac e-Transfer does not guarantee inventory reservation or pricing until payment has been successfully received and verified. 5. Failed, Delayed, or Incomplete Payments If payment is not received, cannot be verified, or is incomplete, the order may remain pending or be cancelled at the Company’s discretion, in accordance with applicable law. 6. Refunds Refunds are handled in accordance with our Return & Refund Policy, which forms an integral part of this Payment Policy. Refunds related to Interac e-Transfer payments are processed manually and may require additional verification. Refund timing may vary depending on the customer’s financial institution. 7. Return Policy
1. Return Eligibility To be eligible for a return, all of the following conditions must be met: The item must be returned within 30 days of the delivery date. The item must be unused, unactivated, and in its original condition and original packaging, including all accessories, tags, labels, and documentation. Proof of purchase (receipt, invoice, or order confirmation) must be provided. ⚠️ Items that have been activated, registered, configured, connected to software or a platform, or used with consumables (including QR-activated consumables) are not eligible for return, except where required by law. 2. Return Process To initiate a return, please follow these steps: Step 1 – Contact Customer Service Notify us within 30 days of receiving the item by email at info@3rvie.ca , stating the reason for the return and providing proof of purchase. Step 2 – Return Authorization (RMA) If your return request is approved, you will receive a Return Merchandise Authorization (RMA) number and return instructions. Returns without an RMA will not be accepted. Step 3 – Return Shipment Ship the item back in its original packaging using a traceable shipping method. Customers are responsible for return shipping costs unless the return is due to our error (incorrect, defective, or damaged item). 3. Inspection & Refunds All returned items are subject to inspection upon receipt. Full Refund Issued when the item is defective, damaged during shipping, or not as described. Partial Refund or Denial May apply when the return is not related to a defect or error. Original shipping costs and handling fees may be deducted where permitted by law. Approved refunds are processed within 10 business days after inspection. Depending on your financial institution, additional processing time may apply. 4. Interac e-Transfer Refunds Refunds for payments made via Interac e-Transfer are processed manually. Refunds may be issued via Interac e-Transfer or another mutually agreed method Processing times vary by financial institution and may take several business days 5. Exchanges If you wish to exchange an item for a different size, color, or model, the same return eligibility and RMA process applies. Exchanges are subject to product availability. If the requested item is unavailable, a refund may be issued in accordance with this policy. 6. Non-Returnable & Non-Refundable Items Except where required under the Québec Consumer Protection Act, the following items are non-returnable and non-refundable: Equipment that has been activated, registered, or connected to software or a platform Consumables, including QR-activated or partially used materials Subscription fees, platform fees, maintenance fees, or “Unlimited Cuts” fees Custom-made or personalized items Perishable goods Gift cards Health and personal care products (including cosmetics and intimate apparel) Items marked as Final Sale 7. Consumer Rights Under Québec Law Nothing in this policy limits or excludes consumer rights granted under the Québec Consumer Protection Act (LPC). In accordance with Québec law: Consumer rights cannot be waived Defective goods may be repaired, replaced, or refunded within a reasonable time Consumers may cancel a purchase if goods are not delivered within 30 days of the promised delivery date For more information, please consult the Office de la protection du consommateur (OPC). 8. Online Purchase Exceptions For online purchases, any defect or non-conformity must be reported within 7 days of delivery. Supporting documentation (photos or videos) may be required. 9. Final Sale Items Items clearly marked as Final Sale are not eligible for return or refund, except if defective or damaged upon arrival, as required by law. 10.
